Terms of service

Parties and scope

Superkoda is provided by OPENKODA CDX Sp. z o.o. sp. k., Łaciarska 4, 50-104 Wrocław, Poland (“we”). These terms apply to every Superkoda app and to the Superkoda platform (the “service”). The service is for business use, so the customer (“you”) is a company or other organisation, not a consumer. The person who accepts these terms confirms they can do so for that organisation.

Accounts

You can add as many users as you need. Keep login details safe and tell us at once if you think an account has been misused. You are responsible for what your users do in the service.

Plans, prices and payment

Prices are listed on the pricing page in US dollars and exclude VAT and sales tax, which we add where the law requires. You pay in advance, monthly or annually; annual billing costs 10 times the monthly price.

New accounts start with a 14-day free trial. No payment details are needed for the trial; to keep using the service afterwards, choose a plan.

Each plan has a size limit. If you go over it, nothing stops working: you get 30 days’ grace, then the next level applies from your next renewal on monthly billing, or as a pro-rated difference on annual billing. We announce price changes for existing customers at least 30 days ahead, and they apply from your next renewal.

Cancellation and data export

You can cancel at any time in the app or by email. Your plan runs until the end of the period you have paid for, and we don’t refund partly used periods. You can export your data at any time, and for 30 days after your subscription ends. After that we delete it, except where the law requires us to keep it.

Customer data

You own the data you put into the service. We use it only to provide the service to you, and we act as your processor under the data processing terms described in our privacy policy. We don’t sell your data.

Changes made with Superkoda AI

Superkoda AI makes changes on a development copy of your app. They reach your users only when you release them, so you are responsible for checking a change before you release it.

Acceptable use

Don’t use the service for anything unlawful, to store content you have no right to, to test or break its security, to harm other customers, or to resell it without our written agreement. If you do, we may suspend the affected accounts. Where we can, we will tell you first and give you a chance to fix the problem.

Availability and support

We work to keep the service available and to fix problems quickly, and we give notice of planned maintenance. Starter and Growth plans don’t include a guaranteed uptime; a contractual service level with credits is part of Enterprise.

Warranties and liability

We provide the service as it is, to the extent the law allows. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, and neither of us is liable for indirect damage or lost profits. These limits don’t apply to damage caused on purpose, or where the law does not allow them.

Changes to these terms

We may update these terms. We will tell you about material changes by email or in the app at least 30 days before they apply. If you don’t agree, you can cancel before then; if you keep using the service after that date, the new terms apply.

Law

These terms are governed by Polish law. If a court finds part of them invalid, the rest still applies.
